GuitarCard is a product of TapTunes, Inc. ("TapTunes," "GuitarCard," "we," "our," or "us"). The GuitarCard website, products, services, memberships, and related content are owned and operated by TapTunes, Inc.

By accessing or using the GuitarCard website, purchasing a GuitarCard, creating an account, or using any related services, you agree to be bound by these Terms & Conditions.

1. User-Submitted Content

GuitarCard is not responsible for any content uploaded, submitted, or linked by users.

By submitting images, information, or any other content, you represent and warrant that you own, control, or have obtained all necessary rights, permissions, and licenses to use, reproduce, and distribute such materials.

You assume full responsibility for ensuring that submitted content does not infringe upon any copyright, trademark, patent, privacy, publicity, or other intellectual property or proprietary rights of any third party.

You agree to indemnify and hold harmless TapTunes, Inc., GuitarCard, its owners, officers, employees, affiliates, partners, and agents from any claims, damages, liabilities, costs, or expenses, including reasonable attorneys' fees, arising from your submitted content or your violation of these Terms & Conditions.

2. Membership & Accounts

A GuitarCard membership is personal and may not be transferred or shared.

You are responsible for maintaining accurate account information and safeguarding your account credentials.

GuitarCard reserves the right to suspend or terminate any account that violates these Terms & Conditions or is used fraudulently, unlawfully, or in a manner that may harm GuitarCard, TapTunes, Inc., or other users.

3. Digital Services

Certain GuitarCard features require internet access and a compatible smartphone or device.

While we strive to provide reliable service, we do not guarantee uninterrupted availability. Features, functionality, and services may be updated, modified, suspended, or discontinued at any time without prior notice.

Temporary interruptions may occur due to maintenance, software updates, internet connectivity, or circumstances beyond our control.

4. Refunds, Returns & Exchanges

All sales are final.

Custom Created GuitarCards: Due to the personalized nature of Custom Created GuitarCards, no refunds, cancellations, returns, or exchanges will be provided once an order has been placed, except in the event of a manufacturing defect or an order fulfillment error by GuitarCard.

Issued: A GuitarCard is considered issued once it has been created and assigned to a customer.

Once a GuitarCard has been issued, removed from its original packaging, registered, or activated, it is not eligible for return, refund, cancellation, or exchange, except in the event of a manufacturing defect or an order fulfillment error by GuitarCard.

If you believe your GuitarCard has a manufacturing defect or was fulfilled incorrectly, you must notify GuitarCard within seven (7) days of delivery. GuitarCard reserves the right to inspect, repair, replace, or otherwise resolve the issue at its sole discretion.

Unauthorized returns will not be accepted.

5. Shipping & Delivery

At this time, GuitarCard ships to U.S. addresses only.

Orders are shipped via USPS unless otherwise specified.

Once an order has been transferred to the shipping carrier, GuitarCard is not responsible for shipping delays, loss, damage, delivery issues, or packages delivered to an incorrect address provided by the customer.

Any shipping claims or delivery issues must be addressed directly with the shipping carrier.

6. Card Functionality

GuitarCard is designed to work with compatible NFC-enabled smartphones or by scanning the QR code printed on the card.

Device compatibility may vary. GuitarCard is not responsible for limitations resulting from incompatible devices, operating systems, internet connectivity, browser settings, software updates, or third-party services beyond our control.

7. Artificial Intelligence (AI)

GuitarCard respects the ownership of your content and personal information.

Images, information, personal information, and all other customer-submitted materials are not used to train generative artificial intelligence (AI), large language models (LLMs), or similar machine learning systems operated by TapTunes, Inc.

If AI-powered features are introduced in the future, they will be designed solely to improve the GuitarCard customer experience and platform functionality.

Customer-submitted content and personal information will not be used for AI model training without the customer's explicit permission.

8. Intellectual Property

GuitarCard, TapTunes®, Tap to Play™, logos, trademarks, graphics, software, website content, and related materials are the exclusive property of TapTunes, Inc. or its licensors and are protected by applicable intellectual property laws.

No portion of the GuitarCard website, software, branding, content, or technology may be copied, reproduced, modified, distributed, reverse engineered, or otherwise used without the prior written permission of TapTunes, Inc.

9. Acceptable Use

You agree not to:

  • Upload or submit unlawful, fraudulent, defamatory, obscene, or infringing content.

  • Misrepresent your identity or ownership of submitted materials.

  • Attempt to interfere with the operation, security, or functionality of the GuitarCard website or services.

  • Use GuitarCard in violation of any applicable law or regulation.

Violation of these Terms may result in the suspension or termination of your account.

10. Disclaimer of Warranties

GuitarCard products, memberships, websites, and services are provided on an "as is" and "as available" basis.

TapTunes, Inc. makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the services will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, TapTunes, Inc., GuitarCard, its owners, employees, affiliates, partners, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to the use of GuitarCard products or services.

Our total liability for any claim shall not exceed the amount paid by the customer for the applicable GuitarCard product giving rise to the claim.

12. Force Majeure

TapTunes, Inc. shall not be liable for delays or failures in performance caused by circumstances beyond its reasonable control, including natural disasters, acts of God, labor disputes, carrier delays, internet outages, governmental actions, pandemics, cyberattacks, or supply chain disruptions.

13. Governing Law

TapTunes, Inc., the owner and operator of GuitarCard, is registered to conduct business in the States of Florida and Tennessee.

These Terms & Conditions and any dispute, claim, or legal proceeding arising out of or relating to the GuitarCard website, products, services, memberships, or related features shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

The parties agree that the state and federal courts located within the State of Tennessee shall have exclusive jurisdiction and venue over any such dispute, claim, or legal proceeding.

14. Changes to These Terms

GuitarCard, TapTunes®, Tap to Play™, and all related names, logos, product names, service names, slogans, software, technology, graphics, website content, and other intellectual property are owned by or licensed to TapTunes, Inc. and are protected by applicable intellectual property laws. All rights reserved.
